Article 1 — Purpose and scope
These Terms & Conditions of Sale (the “Terms”) apply, without restriction or reservation, to any order placed by a consumer within the meaning of the French Consumer Code (the “Customer”) on bomyconcept.com (the “Site”), operated by BOMY CONCEPT SAS, a French simplified joint-stock company with registered office at 7 rue du Cambodge, 75020 Paris, registered under SIRET 105 633 614 00018, EU VAT number FR11105633614 (“BOMY” or the “Seller”).
Any order placed on the Site implies the Customer's unreserved acceptance of these Terms. The Customer acknowledges having read them before validating the order, by ticking the corresponding checkbox.
Article 2 — Products
The products offered for sale are those listed on the Site on the day the Customer browses, subject to available stock. The essential characteristics, price and, where applicable, options of the products are described on each product page. Product photographs are non-contractual; minor variations in appearance, colour or finish may occur.
Article 3 — Order
The Customer places an order by selecting the desired products, validating the cart and entering contact and payment information. The order is definitively confirmed once payment has been accepted. A confirmation email summarising the order is sent to the Customer.
BOMY reserves the right to refuse or cancel any order on legitimate grounds, in particular in the event of a previous dispute, suspected fraud, incorrect information or out-of-stock items. The Customer will be informed by email and refunded in full where applicable.
BOMY also reserves the right to cancel any order resulting from an obvious error in price or description. In such a case, the Customer will be informed by email as soon as possible and fully refunded for any amounts already paid.
Article 4 — Price
Prices are quoted in euros, all taxes included, excluding shipping costs. Shipping costs are stated before the order is validated, based on the delivery address and selected shipping method. BOMY reserves the right to change prices at any time; products will, however, be invoiced at the rates in effect when the order is validated.
Article 5 — Payment
Payment is made online at the time of order, by credit card or any other means offered on the Site. Payments are secured by our payment provider Stripe Payments Europe Ltd.. BOMY never has access to the Customer's bank details, which are transmitted in encrypted form directly to the provider.
The Seller reserves the right to suspend or cancel any order and/or delivery, regardless of its nature or the stage of performance, in the event of payment default or incident.
Article 6 — Delivery
Products are delivered to the address specified by the Customer when placing the order. Delivery times shown on the Site are indicative and run from the order confirmation date.
In accordance with article L. 216-2 of the French Consumer Code, in the event of failure by the Seller to deliver on the date or by the deadline indicated, the Customer may terminate the contract, by registered letter with acknowledgement of receipt or in writing on another durable medium, if the Seller has not delivered within an additional reasonable period demanded by the Customer. The Customer will then be refunded the entire amount paid no later than fourteen days after termination.
The risk of loss or damage to the products is transferred to the Customer when the Customer, or a third party designated by the Customer, takes physical possession of the products.
Pre-orders — Products offered for pre-order are manufactured after the campaign has been validated or production has been launched. The timeframes indicated are estimates based on the development and manufacturing schedule. They may evolve due to industrial, logistical or supply constraints beyond BOMY's control.
Inspection upon delivery — The Customer is invited to check the apparent condition of the parcel and the products upon delivery. Any anomaly observed must be reported to the carrier and to BOMY as soon as possible.
Article 7 — Right of withdrawal
Pursuant to articles L. 221-18 et seq. of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of the product to exercise their right of withdrawal, without having to give reasons or pay any penalty.
To exercise this right, the Customer must notify BOMY of their decision by email to support@bomyconcept.com or by post to the registered office, by means of an unambiguous statement. The Customer may use the standard withdrawal form template found in the annex of the French Consumer Code, but is not required to do so.
In the event of withdrawal, the Customer must return the products in their original packaging, to the address provided, within fourteen (14) days of communicating the decision to withdraw. Return shipping costs are borne by the Customer. The Customer may be held liable for any depreciation of the product resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the product.
BOMY will refund the Customer all sums paid, including standard delivery costs, no later than fourteen (14) days after the date BOMY is informed of the withdrawal decision, using the same means of payment as for the initial transaction unless expressly agreed otherwise. BOMY may defer the refund until receipt of the products or until the Customer has provided proof of shipment, in accordance with article L. 221-24 of the Consumer Code.
Article 8 — Legal warranties
Independently of any commercial warranty granted, the Seller remains liable for any lack of conformity of the goods with the contract and for hidden defects under the conditions of articles L. 217-3 et seq. of the Consumer Code and articles 1641 et seq. of the Civil Code.
Legal warranty of conformity — The Customer has two (2) years from delivery of the goods to act. The Customer may choose between repair or replacement of the goods, subject to the cost conditions provided for in article L. 217-12 of the Consumer Code. The Customer is not required to prove the existence of the lack of conformity during the twenty-four (24) months following delivery of the new goods.
Warranty against hidden defects — The Customer may choose to invoke the warranty against hidden defects of the item sold within the meaning of article 1641 of the Civil Code. In this case, they may choose between terminating the sale or reducing the sale price in accordance with article 1644 of the Civil Code.

Article 10 — Liability
The products offered on the Site comply with French legislation in force. BOMY shall not be held liable for non-compliance with the legislation of the country where the products are delivered; it is the Customer's responsibility to check with local authorities for the possibilities of importing or using the products.
BOMY shall not be held liable for any non-performance of the contract concluded in the event of force majeure, total or partial disruption or strike, particularly affecting postal services and means of transport and/or communications.
Article 11 — Intellectual property
All elements of the Site, whether visual or audio, including the underlying technology, are protected by copyright, trademark or patent law. They are the exclusive property of BOMY CONCEPT SAS. No licence or right other than that of consulting the Site is granted to the Customer.
Article 12 — Personal data
The data collected when placing an order is processed for the purposes of order management, payment, delivery and customer relations. For more information, the Customer is invited to consult our privacy policy.
Article 13 — Dispute resolution and mediation
In the event of a complaint, the Customer is invited to contact BOMY's customer service first at support@bomyconcept.com in order to seek an amicable solution.
In accordance with articles L. 611-1 et seq. of the French Consumer Code, after a prior written request to BOMY has remained unresolved, the consumer Customer may, free of charge, refer the matter to the consumer mediator to which BOMY subscribes:

Article 14 — Governing law
These Terms are governed by French law. Any dispute relating to their interpretation or performance shall fall under the jurisdiction of the French courts, subject to the mandatory rules of jurisdiction applicable to consumers.
